Terms of Service

These Terms of Service (“Terms”) govern your use of the YesChef platform operated by YesChef (Pty) Ltd (Registration No. 2025/XXXXXX/07), a company registered in the Republic of South Africa (“YesChef”, “we”, “us”, “our”). By accessing or using the platform, you agree to be bound by these Terms.
1. Nature of the Platform
YesChef is a technology platform that facilitates food ordering between customers and independent food vendors at markets, festivals, and events. YesChef is not a food vendor, restaurant, or food delivery service. We do not prepare, cook, handle, or deliver food. Each vendor listed on the platform operates independently and is solely responsible for their products, food safety, and compliance with applicable health regulations.
2. Definitions
- Vendor: A business or individual registered on YesChef to sell food products through the platform.
- Customer: Any person who places an order through the platform.
- Order: A request by a Customer to purchase food items from a Vendor through the platform.
- Platform: The YesChef website, web application, and all related services.
3. Vendor Terms
3.1 Registration and Approval
Vendors must register for an account and be approved by YesChef before listing products. Approval is at our sole discretion. We may request proof of business registration, health certificates, or other documentation.
3.2 Vendor Responsibilities
Vendors are responsible for:
- The accuracy of their menu listings, including descriptions, allergen information, and pricing.
- Compliance with all applicable food safety, health, and hygiene regulations, including the Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972.
- Fulfilling accepted orders within a reasonable time and to an acceptable standard.
- Holding valid permits or licences required to sell food at their operating location.
- Managing their availability status and promptly declining orders they cannot fulfil.
3.3 Terms Acceptance
Vendors accept these Terms upon registration. When Terms are updated, vendors will be notified and must accept the updated Terms to continue using the platform. Continued use after notification constitutes acceptance.
4. Fees and Payment
4.1 Platform Fee
YesChef charges a platform fee of R 5.00 (five South African Rand) or 5% (five percent) of the order total, whichever is higher. This fee is deducted from the order amount before settlement to the vendor.
4.2 Payment Processing
All payments are processed by Yoco Technologies (Pty) Ltd (“Yoco”), a registered payment service provider. Yoco's standard card processing fees apply in addition to the YesChef platform fee. YesChef does not store credit card details.
4.3 Settlement
Vendor payouts are processed according to Yoco's standard settlement schedule. YesChef is not responsible for delays caused by Yoco, banks, or other payment intermediaries.
5. Orders and Fulfilment
5.1 Order Acceptance
Placing an order constitutes an offer to purchase from the Vendor. The order is confirmed only when the Vendor accepts it through the platform. Until acceptance, the Vendor may decline the order and a full refund will be processed.
5.2 Order Collection
Customers must collect their orders from the Vendor's stall using the confirmation code provided. YesChef does not provide delivery services. Uncollected orders remain the responsibility of the Customer.
6. Refunds
Refunds are initiated by the Vendor through Yoco and processed according to Yoco's refund policy. Vendors may refund orders that they cannot fulfil. YesChef may facilitate refunds in exceptional circumstances but is not obligated to do so. Refund processing times are determined by the Customer's bank and are outside YesChef's control.
7. Customer Terms
7.1 Acceptance
Customers accept these Terms by completing a purchase on the platform. A link to these Terms is displayed on the checkout page.
7.2 Customer Rights
In accordance with the Consumer Protection Act 68 of 2008 (CPA), Customers have the right to:
- Receive goods that match the description provided on the platform.
- A refund for orders that are not fulfilled by the Vendor.
- Lodge complaints about Vendors through the platform or by contacting our support team.
8. Data Protection and Privacy
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Privacy Policy details how we collect, use, store, and protect your information. By using the platform, you consent to the processing described in the Privacy Policy.
9. Intellectual Property
The YesChef name, logo, platform design, and all related intellectual property are owned by YesChef (Pty) Ltd. Vendors retain ownership of their brand names, logos, and product images uploaded to the platform. By uploading content, Vendors grant YesChef a non-exclusive, royalty-free licence to display that content on the platform.
10. Limitation of Liability
To the maximum extent permitted by South African law, including Section 61 of the CPA:
- YesChef is not liable for the quality, safety, or legality of food sold by Vendors through the platform.
- YesChef is not liable for the accuracy of menu descriptions, allergen information, or pricing set by Vendors.
- YesChef's total liability for any claim arising from use of the platform shall not exceed the platform fees paid by the claimant in the twelve months preceding the claim.
- YesChef is not liable for indirect, consequential, or incidental damages, including lost profits or revenue.
11. Platform Availability
We aim to maintain platform availability but do not guarantee uninterrupted service. We may suspend or restrict access for maintenance, updates, or circumstances beyond our control. We are not liable for losses arising from platform downtime.
12. Account Suspension and Termination
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, receive repeated customer complaints, or for any reason at our reasonable discretion. Vendors may close their account at any time. Outstanding fees remain payable.
13. Dispute Resolution
Disputes between Customers and Vendors should be resolved directly between the parties. YesChef may mediate but is not obligated to do so. Any disputes with YesChef shall be governed by South African law and subject to the jurisdiction of the courts of the Western Cape High Court, Cape Town.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered vendors and displayed on the platform. The “Last updated” date at the top of this page indicates the most recent revision. Continued use of the platform after changes constitutes acceptance.
